1. Introduction
Welcome to PublicServiceQuadrant ("we," "our," or "us"). These Terms & Conditions ("Terms") govern your use of our yacht charter services and website located at publicservicequadrant.sbs (the "Service") operated by PublicServiceQuadrant.
By booking a charter or accessing our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.
2. Service Overview
PublicServiceQuadrant offers luxury yacht charter services, which include:
- Daily yacht rentals
- Sunset cruises
- Corporate retreats
- Private events
- Multi-day charters
Service availability may vary and is dependent on weather conditions. We are entitled to alter or withdraw services without prior notice.
3. Booking and Reservations
3.1 Booking Process
For reservation of a charter, you are required to:
- Be at minimum 18 years old
- Provide truthful and complete details
- Submit the specified deposit outlined in your booking confirmation
- Accept these Terms & Conditions
3.2 Confirmation
Confirmation of your booking occurs after we receive your payment and send you a written confirmation. We retain the authority to decline service at our own discretion.
3.3 Availability
Charter bookings are subject to the availability of the vessel and favorable weather conditions. We will exert reasonable efforts to accommodate your preferred scheduling.
4. Payment Terms
4.1 Pricing
All fees are stated in € and are inclusive of applicable taxes unless mentioned otherwise. Fee structures are subject to change without prior notice.
4.2 Payment Schedule
- Deposit: You are required to pay 50% of the total charter cost at the time of booking.
- Balance: The remainder is due 48 hours prior to the charter departure.
- Other fees (if applicable): Payable at the end of the charter.
4.3 Payment Methods
Payments can be made using major credit cards, bank transfers, and certified cheques. All payment processes are secure and encrypted.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- Over 72 hours before departure: Entire refund minus processing costs
- Between 24-72 hours before departure: Half refund
- Less than 24 hours prior to departure: No refund awarded
5.2 Weather Cancellations
In case the captain deems the weather conditions unsafe, we will propose to either:
- Reschedule the charter at no additional expense
- Issue a complete refund if a reschedule is unfeasible
5.3 Mechanical Issues
If your assigned vessel encounters mechanical failure, we will endeavor to provide an alternative option. If this isn't available, we will issue a full refund.
6. Safety and Conduct
6.1 Safety Requirements
It is mandatory for all passengers to:
- Adhere to the instructions provided by the crew
- Utilize safety equipment when required
- Inform us of any medical conditions that could affect safety
- Stay within designated areas on the vessel
6.2 Prohibited Items
The following items are prohibited on board:
- Glass containers
- Illegal substances
- Firearms or weapons
- Intoxicating substances beyond reasonable quantities for consumption
- Pets (excepting those pre-approved)
6.3 Conduct
Passengers are expected to behave respectfully. Should behavior of a passenger pose a safety threat or impair the enjoyment for others, we reserve the right to conclude the charter beforehand, with no refund provided.
7. Liability and Insurance
7.1 Our Liability
Liability on our end is confined to the price paid for the charter. We are not responsible for:
- Injuries sustained due to visitors' negligence
- Theft or damages to personal belongings
- Indirect or punitive damages
- Delays originating from adverse weather or other uncontrollable factors
7.2 Insurance Coverage
We possess comprehensive insurance covering our fleet and operations. Guests are in charge of securing their own travel and personal insurance.
7.3 Assumption of Risk
Engaging in our charter activities signifies your recognition of inherent marine risks and your acceptance of personal responsibility for your security and safety.
8. Modifications and Itinerary Changes
We hold the right to alter itineraries, paths, or schedules due to weather conditions, safety reasons, or other operational requirements. We will strive to offer comparable substitute experiences.
9. Force Majeure
We cannot be held accountable for any delays, cancellations, or alterations brought about by events beyond our capability to control, which include but are not limited to:
- Extreme meteorological events
- Natural catastrophes
- Legal stipulations
- Closures of ports
- Technical mechanical failures
10. Privacy and Data Protection
Your private information will be processed in line with our Privacy Policy. Your use of our service signifies your consent to our data collection and usage as stipulated in the Privacy Policy.
11. Intellectual Property
All materials on our website, such as texts, visuals, logos, and images, are under copyright and intellectual property protection. Unauthorized reproduction, distribution, or creation of derivative works is prohibited without our express written permission.
12. Governing Law
These Terms are subjected to the laws in force within Italy. Any arising disputes will be settled in the courts pertaining to Porto Cervo, Italy.
13. Changes to Terms
We preserve the authority to modify these Terms as needed. Revisions will be disclosed on our website and will include the revision date. Continual usage of our services denotes acceptance of updated Terms.
